2. ABOUT AETHERLENZ

AetherLenz operates as a platform and managed media-operations service that connects End Users with photographers, videographers, Organizers, venues, attractions, event operators, Venue Partners, and AetherLenz-managed field teams across travel, event, venue, attraction, sports, tourism, and other high-volume experience settings. Our mission is to help End Users locate, preview, purchase, and enjoy high-quality photos and videos featuring their likeness. We utilize advanced technologies, including facial recognition, media indexing, QR-led access, referral attribution, Token commerce, and AI-enhanced photo and video processing, to help End Users find and purchase media featuring their likeness.

3. ABOUT THIS PRIVACY POLICY

This Privacy Policy outlines how we collect, store, process, use, and disclose personal information, including both data we collect directly from you and information submitted to us through the AetherLenz platform.

4. DEFINITIONS

AetherLenz Platform: The online service and managed media-operations ecosystem operated by AetherLenz, accessible at aetherlenz.com and related portals, where users can upload, index, search, preview, purchase, download, route, attribute, and manage photos, videos, and similar media. aetherlenz.com

Organizer: A local business, agency, operator, venue, attraction, event operator, tourism project, or other authorized entity that has registered on or partnered with the AetherLenz Platform to manage photography or media collections, engage photographers or videographers, or coordinate media operations. Depending on the arrangement, AetherLenz may also act as the operating Organizer or managed service operator for a location or event.

Photographer / Videographer: An individual affiliated with an Organizer or AetherLenz-managed operation who provides photography or video services, uploads or assists with media, uses approved QR flows, or participates in field-level End User activation.

End User: Individuals who use the platform to search for, preview, purchase, and download photos, videos, or similar media that include their likeness.

User: A collective term for Organizers, Venue Partners, Photographers, videographers, End Users, site captains, field personnel, or any individual that uses or participates in the AetherLenz platform or managed operations.

Personal Information: Information that identifies an individual, such as name, email address, contact number, IP address, or any data that can reasonably be linked to an identifiable individual.

Face Data: Information derived from facial features, Reference Photos, face templates, face indexes, liveness-related data, matching results, or similar facial-feature-derived data that may be processed using AI services to enable photo or video matching, recognition, liveness verification, fraud prevention, security, and account protection. AetherLenz treats Face Data as high-risk personal data and applies heightened safeguards, access controls, purpose limitation, and retention controls in accordance with applicable law.

Liveness Verification: A security process that ensures the person registering and uploading Reference Photos is physically present and the legitimate owner of the photos. Liveness verification is conducted every three months to confirm active user status.

Face Analysis: A process using AI services, such as AWS AI Services, to analyze facial features in uploaded photos, videos, or similar media to enable indexing, searching, matching, liveness verification, and identification of media that may contain the user's likeness.

Minor: An individual under the age of 18 years.

Nominee for Minor: An authorized adult, usually a parent or legal guardian, who consents on behalf of a minor to the collection and use of the minor's personal information.

IP Address: A unique identifier used to locate computers over the internet. We collect IP addresses automatically when you use our platform.

Cookies: Small files placed on your device when you visit our website that collect and store information about your interactions with our platform. Cookies help us improve user experience and provide personalized services.

Browser Type and Version: Information about the browser software you use to access our platform, which helps us optimize our services for different technologies.

Location Data: Information about your geographic location, which can be enabled or disabled through your device settings. This data helps us provide location-based services.

Organizer QR Code: A QR code generated, assigned, or approved by AetherLenz for an Organizer, Organizer profile, or Organizer collection access flow. When scanned, it may point or route End Users to the AetherLenz.com landing page or End User portal, where End Users may register or log in, view collections created or managed by the Organizer, subscribe to be notified when a collection is published, and, for published collections, access previews from the selected collection after uploading a selfie or Reference Photo and completing required Platform steps. Organizer QR Codes provide an alternative faster media access path.

Photographer Invite QR Code: A QR code generated, assigned, or approved by AetherLenz that allows interested photographers or videographers to access the Photographer Portal, register or log in, and submit a request to join or become affiliated with a specific Organizer. Organizers may approve or deny these requests through the Organizer Portal.

Photographer Referral QR Code: A photographer- or videographer-specific End User access QR code generated, assigned, or approved by AetherLenz when the Photographer or videographer is added to or associated with a collection, Organizer, location, event, or AetherLenz-managed operation. It may route End Users to relevant AetherLenz flows and may be used to count the number of End Users referred or onboarded through the Photographer or videographer and the average number of photos purchased by those onboarded End Users.

AetherLenz Managed Operations: A service model where AetherLenz acts as the practical operating Organizer, managed service provider, venue media concessionaire, or outsourced media-operations provider for a venue, attraction, event, location, or partner. This may include staffing, site captains, training, equipment kits, QR deployment, End User activation, customer handling, media upload, quality control, reporting, support, payout administration, and compliance coordination.

Venue Partner: A venue, attraction, event operator, tourism project, brand, property owner, concession grantor, or similar partner that grants AetherLenz or an Organizer access, location rights, brand permissions, traffic access, exclusivity, or commercial rights to operate media services at a location or event.

Referral and Attribution Data: Data generated when Photographer Referral QR Codes, links, collection flows, registrations, onboarding events, and purchases are associated with a Photographer, videographer, Organizer, Venue Partner, location, shift, route, event, collection, or AetherLenz-managed operation. Referral reporting is limited to the number of End Users referred or onboarded through the Photographer or videographer and the average number of photos purchased by those onboarded End Users, and may be used for routing, reporting, incentive calculation where applicable, fraud prevention, quality control, commercial analysis, and performance management, subject to privacy restrictions and Platform permissions.

5. WHEN DO WE COLLECT YOUR INFORMATION?

We collect your information at various points depending on your role on the AetherLenz platform:

Organizers and Venue Partners: When you register on, partner with, or use our platform, we collect business details, contact information, financial or withdrawal information, bank or e-wallet QR codes if uploaded, QR Code configuration or approval data, photographer or videographer invite and approval records, location or venue information, brand permissions, operational documents, managed-operation settings, commercial terms, reporting preferences, and documents proving your authority to operate or grant access at specific locations. This occurs when you create an account, update your profile, manage collections, configure withdrawal settings, share Organizer QR Codes, manage Photographer Invite QR Code requests, participate in AetherLenz Managed Operations, or coordinate venue or event operations.

Photographers, videographers, prospective photographers or videographers, site captains, and field personnel: When you register, request affiliation, are assigned to a collection, participate in AetherLenz Managed Operations, use a Photographer Invite QR Code, or use a Photographer Referral QR Code, we collect your name, contact details, professional information, submitted portfolio or credentials if provided, selected or inviting Organizer, AetherLenz-managed operation assignment, affiliation request details, approval or denial status, referral QR assignment, scan and conversion attribution, shift, route, location, equipment accountability, incentive, payout, performance, quality, customer interaction, and audit-log information.

End Users: We collect your email address when you register, and during checkout, we collect your name, email address, country, and IP address. Additionally, we collect face data when you upload a selfie, upload or update Reference Photos, or interact with photos or videos that include your likeness. End Users who wish to view uploaded media must upload a selfie or Reference Photo and complete required Platform steps; Uploaded media cannot be viewed through the Platform without uploading a selfie or Reference Photo and completing required Platform steps. When you scan or use an Organizer QR Code or Photographer Referral QR Code, we may collect scan, referral, routing, Organizer, Photographer or videographer, Venue Partner, managed-operation, location, shift, route, event, collection access, account registration, login, subscription, notification preference, preview access, purchase, device, and technical information to route you to the relevant AetherLenz flow, show Organizer or Venue Partner collections, notify you when subscribed collections are published, support media access, and count the number of End Users referred or onboarded through a photographer or videographer and the average number of photos purchased by those onboarded End Users. Face data may be processed by AWS AI Services and/or AetherLenz-controlled systems to support indexing, search, matching, liveness verification, fraud prevention, security, and account protection.

Name, contact details, professional information, portfolio or credentials if submitted, selected or inviting Organizer, Photographer Invite QR Code referral data, request status, and approval or denial records.

Collected when a person scans or uses a Photographer Invite QR Code, registers through the Photographer Portal, and submits a request to join an Organizer.

Venue Partners and Managed Locations

Operational and Commercial Information

Location access, brand permissions, operating permissions, exclusivity, staffing, site captain, equipment, reporting, incident, support, refund, commercial, revenue-share, minimum guarantee, retainer, venue share, and performance information.

Collected during partner onboarding, managed-operation setup, venue operations, reporting, support, incident handling, and commercial administration.

All Relevant Business Users

Referral and Attribution Data

Photographer Referral QR Code scans, registrations, onboarding events, and purchase averages associated with Photographers, videographers, Organizers, Venue Partners, collections, or AetherLenz-managed operations. Referral reporting is limited to the number of End Users referred or onboarded and the average number of photos purchased by those onboarded End Users.

Collected when Photographer Referral QR Codes, links, collection flows, registrations, onboarding events, purchases, or related Platform interactions occur.

7. FACE ANALYSIS AND AWS AI SERVICES

AetherLenz uses Face Analysis through AWS AI Services and/or AetherLenz-controlled systems to facilitate photo and video search, indexing, matching, liveness verification, fraud prevention, security, and account-protection features. When you upload a selfie or Reference Photo, or when photos or videos are uploaded by photographers, data may be processed to index media and identify potential matches with your likeness. The Platform generally indexes uploaded media and does not permanently associate media with a specific End User upon upload; matching may occur when an End User initiates or updates a search, subject to technical limitations, lawful basis, and applicable notice or consent requirements. Uploaded media may therefore be indexed and later searched or matched when an End User uploads, updates, or uses Reference Photos.

Data Sharing with AWS: When you upload a selfie or Reference Photo, or when uploaded media is processed for indexing, liveness verification, search, or matching, relevant data may be processed by AWS AI Services as a service provider for AetherLenz. AetherLenz may receive, generate, store, or use AetherLenz-controlled records such as Reference Photos, account records, search requests, matching results, liveness status, logs, settings, and audit records. AWS processes relevant service-provider data under applicable AWS terms and security controls, while AetherLenz remains responsible for AetherLenz-controlled collection, use, disclosure, and Platform records.

Liveness Verification: To confirm the continued activity of your account, liveness verification will be conducted every three months. If liveness verification is not successfully completed, your face data will be deleted after six months from the last successful verification.

Data Retention: Face Data, Reference Photos, face templates or indexes, liveness-related data, matching results, logs, and related service-provider or Platform records are retained only as long as necessary for Platform operation, account activity, liveness verification, legal compliance, dispute resolution, fraud prevention, security, accounting, audit, support, and legitimate business records, subject to applicable law, user rights, and Platform settings.

8. PROVIDING INFORMATION FOR SOMEONE ELSE

If you provide personal information on behalf of someone else, such as a minor or another individual, you must have their consent to provide their information to AetherLenz in accordance with this Privacy Policy. If providing information for a minor, you must be their parent or legal guardian and provide consent on their behalf. By registering or using the Platform, an End User represents that they are at least eighteen (18) years old or have valid consent and supervision from a parent or legal guardian. If AetherLenz becomes aware that a minor used the Platform without proper consent, AetherLenz may suspend the account, restrict access, delete relevant data or media where appropriate, or require guardian confirmation.

9. WHY DO WE COLLECT, STORE, AND USE YOUR PERSONAL INFORMATION?

AetherLenz collects, stores, and uses personal information for the following purposes:

We also process Organizer financial or withdrawal information, including uploaded bank or e-wallet QR codes where provided, to facilitate withdrawal requests, verify payment instructions, prevent fraud, and maintain transaction records.

Where Organizers, Photographers, videographers, or AetherLenz-managed operations enable media enhancement options or select AetherLenz-provided Enhancement Presets, AetherLenz may process photos and videos, collection identifiers, preset selections, configuration settings, processing status, provider logs, quality-control information, and related metadata using internal and/or third-party software before, during, or after upload to a collection. This processing is used to improve quality, support Platform services, and prepare media for preview, search, sale, or download.

If an approved Organizer uses Growth Mode or zero-Token photo settings, AetherLenz may process transaction, collection, pricing, usage, and performance data to administer the applicable revenue split, monthly photo limits, fraud controls, and commercial approvals.

If an End User scans or uses an Organizer QR Code, AetherLenz may process scan, referral, Organizer, collection, routing, registration, login, subscription, notification preference, preview access, selfie or Reference Photo requirement status, device, and technical data to open the AetherLenz.com landing page or End User portal, show Organizer collections, notify subscribed End Users when collections are published, provide previews from published collections after required selfie or Reference Photo upload and Platform steps, prevent misuse, and maintain audit logs.

If an End User scans or uses a Photographer Referral QR Code, AetherLenz may process scan, referral, Photographer or videographer, Organizer, Venue Partner, managed-operation, location, route, shift, event, collection, registration, login, subscription, notification preference, preview, purchase, device, and technical data to route the End User to relevant AetherLenz flows, count End Users referred or onboarded through the Photographer or videographer, calculate the average number of photos purchased by those onboarded End Users, administer incentives where applicable, prevent fake scans or fraud, support customer service, and maintain audit logs.

If a prospective photographer or videographer scans a Photographer Invite QR Code, AetherLenz may process registration, profile, contact, professional, portfolio, Organizer referral, affiliation request, approval, denial, and audit-log data to route the applicant to the Photographer Portal and allow the Organizer to review and administer the request.

If AetherLenz provides Managed Operations, AetherLenz may process staffing, site captain, shift, route, equipment, location, customer interaction, upload, quality assurance, incentive, payout, venue, commercial, contribution margin, support, refund, incident, and performance data to operate, supervise, report on, and improve the managed location or event.

Venue Partner Reporting

To provide authorized Venue Partners and business users with operational, commercial, collection, scan, preview, purchase, conversion, support, refund, and performance reporting reasonably necessary to operate or evaluate the relevant location or event, subject to privacy restrictions.

10. WHO DO WE SHARE YOUR PERSONAL INFORMATION WITH AND WHY?

AetherLenz may share your personal information with third parties under the following circumstances. Face Data may be processed by AWS AI Services as a service provider for facial analysis, liveness verification, indexing, search, and matching. Uploaded media, preset selections, enhancement configurations, processing metadata, and quality-control data may also be processed using AetherLenz internal tools and/or third-party AI or editing software for enhancement or editing where enabled by the Platform, Organizer settings, Photographer options, videographer options, selected Enhancement Presets, or AetherLenz-managed operation settings:

Service Providers: Third-party providers assist us in delivering our services, including cloud storage providers, payment processors, AI media enhancement providers, and other technology vendors. These providers handle personal data in compliance with our policies, contractual safeguards, and legal requirements.

Organizers reviewing Photographer Invite QR Code requests: If you submit a photographer or videographer affiliation request through a Photographer Invite QR Code, your submitted profile, contact, professional, portfolio, and request information may be shared with the relevant Organizer for review, approval, denial, supervision, and account administration.

Photographer profile display: When media previews are shown to End Users, AetherLenz may display the Photographer's or videographer's name, contact information, portfolio links, and profile information provided or approved through the Platform so End Users can identify the creator or service provider associated with the media.

Organizer QR Code collection access and notifications: When End Users use Organizer QR Codes, AetherLenz may share collection access, subscription, notification, transaction, sales, preview, and performance information with the relevant Organizer as reasonably necessary to operate the Platform. End User Reference Photos, Face Data, and personal contact information are not shared with Organizers except as described in this Privacy Policy, with consent, or as required by law.

Photographer Referral QR Code and managed-operation reporting: When End Users use Photographer Referral QR Codes or interact with AetherLenz Managed Operations, AetherLenz may share limited referral count, onboarded End User count, average photos purchased by onboarded End Users, collection, route, shift, location, event, and performance information with the relevant Organizer, Venue Partner, Photographer, videographer, site captain, or authorized business user as reasonably necessary for routing, reporting, incentive calculation, fraud prevention, quality control, commercial analysis, or performance management. End User Reference Photos, Face Data, personal contact details, and sensitive Platform data are not shared with Photographers, videographers, Organizers, Venue Partners, or site captains except as described in this Privacy Policy, with consent, as required by law, or under appropriate safeguards authorized by AetherLenz.

Law Enforcement: Personal information may be shared with law enforcement or other authorities if required by law or necessary to protect our rights and safety.

Business Transfers: In the event of a merger, acquisition, or sale of AetherLenz, your personal information may be transferred as part of the business assets to the new owner.

11. Responsibilities of Organizers, Venue Partners, Photographers, Videographers, and Managed Operations

Organizers, Venue Partners, Photographers, videographers, site captains, and AetherLenz-managed field teams must ensure that End Users are clearly informed and have provided freely given, specific, and explicit consent prior to capturing any photo or video where required by law, Platform policy, or the applicable collection notice.

No media may be captured or uploaded unless required consent, notices, or lawful basis have been obtained or documented where required, and it is the Organizer's, Venue Partner's, or AetherLenz-managed operation's duty, as applicable, to document, verify, or coordinate this process. This ensures compliance with the Philippine Data Privacy Act and applicable privacy and facial recognition safeguards.

Uploaded media may be indexed and later searched or matched when an End User uploads, updates, or uses Reference Photos. Organizers, Venue Partners, Photographers, videographers, site captains, and AetherLenz-managed field teams must ensure that collection notices, QR materials, customer scripts, consent materials, and operational practices disclose this indexing, later matching, and referral attribution capability where required by law or Platform policy.

Where legally required or operationally feasible, AetherLenz may review, restrict access to, remove, delete, or coordinate with the relevant Organizer regarding media that is alleged to be unlawful, non-consensual, privacy-invasive, or otherwise in violation of Platform policy. This does not guarantee that AetherLenz can identify every person appearing in media or provide automated masking, blurring, or takedown technology.

Uploaded media that is not purchased may be deleted seven (7) to thirty (30) days after the collection is first published, depending on the Organizer-selected or Platform-enabled auto-deletion period. Purchased media remains available in the End User account while the account remains active unless deleted by the End User, the End User deletes the account, or deletion is otherwise required by law or Platform policy.
